Common Violations

The HOA management company is charged with performing periodic field inspections of individual lots in Capital Court to identify potential violations. When a violation is confirmed, the homeowner will be issued a violation notice from the management company. All homeowners should contact the management company or the ACC, capitalctacc@gmail.com, for any questions regarding architectural changes and design guidelines.

A homeowner in violation of the Design Guidelines will first be issued a warning from the ACC to cure any violations on their property. Click here to view the complete Covenant and Rule Policy which outlines the enforcement process.

The following common violations are either prohibited or require an application. Click on the violation for more information.

Applications - Homeowners MUST submit applications for exterior, design changes to their homes.

Charcoal grills - Charcoal grills may NOT be used on decks.

Commercial Vehicles - Commercial vehicle parking is prohibited in the community. This excludes vehicles that homeowners have contracted for professional services for the day. No overnight parking.

Decks - Decks must be compatible in scale and design with the home as sited on the lot, as well as of the same style and type as the builder has initiated. Screening will be evaluated on a case by case basis. Deck color must be that of a natural wood. If you are using a color not on the ACC’s approved list, please submit and application.

Exterior Lighting - Exterior lighting must be compatible in design, scale, color, finish and location with the home and neighboring lots.

Fences - Fences must follow the line of the property and is subject to compliance with all existing easements located on the property. Side yard fencing will be permitted on end unit yards. In this case, however, the fence must be terminated within 5’ of the rear wall. Fences must not be taller than six feet (6’) and not shorter that five feet (5’) tall. Fences require an application and a permit.

Fire Pits, Fireplaces, and Chimneas (Fixed or Portable) - Per County Law, these devices are prohibited on decks and balconies. Fires in these devices must be 30 feet from any road, sidewalk or public way.

Grass/Landscaping - The overall aesthetic appearance of the community has a natural look. This includes the exterior landscaping. Most color plants are not approved for landscaping. Landscaping can only be replaced with similar shrubbery and ornamental plants/grass. Although, the Association pays for all the grass to be cut in the community, homeowners are otherwise responsible for the upkeep and maintenance of the lawn on their lots.

Pathway/Landscape Lights - Pathway/Landscape lighting may be approved with an application. These lights hinders the efficient manicuring of homeowners lawns by the landscaping contractor. The contractor is not liable for damage to prohibited lights on individual lots.

Recreation and Play Equipment - Play equipment must be located and stored on the owner’s lot. A homeowner’s play equipment shall not be stored in the street or any other common area of the community.

Storm/Screen Doors and Windows - Storm/Screen doors must be full-view and must be painted the same color as the entry door behind them or the same color as the surrounding wood trim.

Trash/Recycle bins - Bins must be stored in an area not visible from a street or another lot. This is interpreted as being stored in your garage as trash bins are visible to your neighbors if kept anywhere on your lot outside of your garage.
