ACC Exceptions

The Board of Directors understands that our current CC&Rs and Design Guidelines are generic in nature, therefore, the Board will occasionally make exceptions to our rules. The Board wants to ensure that the interpretations of our rules are objective and apply to all homeowners. The homeowners’ association cannot be “arbitrary and capricious” in its enforcement of the rules. Until our documents are revised to include specific descriptions of ambiguous rules, we will post those exceptions here. Exceptions based on new Maryland laws will also be posted here.

HB-1347 Real Property - Impermissible Restrictions on Use - Portable Basketball Apparatuses (effective 10/01/2021

HOAs cannot impose unreasonable limitations on the location and use of a portable basketball apparatus provided that the property owner owns or has the right to exclusive use of the area (lot) where the portable basketball apparatus is located.
